Child Support - Why a Post-Divorce Modification is Necessary
When sudden job loss or illness strikes, it's not uncommon for ex-spouses to agree to a change in child support payments. While both parties may agree to a temporary halt or increase in payments, neither has the legal authority to do so. Child support is a duty owed a child, not the custodial parent. As such, only the court can legally sanction a change in child support.
Even if you believe your change in circumstances is temporary, you could be held financially responsible for back-owed child support and interest on it if the court finds out (or if your ex-spouse decides to sue you at a later date). And, if you are the custodial parent, you can also be held in contempt if the court discovers you agreed to a change in child support payments without its approval.
