Stepparent Adoptions in Missouri

Stepparent adoption is a way to make the bond between a stepparent and their stepchild official and secure under the law. 1. Check Eligibility

  • The stepparent must be married to the child’s parent.
  • Is the child living with the stepparent for a period of time, usually at least six months?

2. Get Consent from the Other Parent

  • If the other biological parent is still living, are they in agreement?
  • In some situations, such as if that parent has abandoned the child, cannot be found, or has had their parental rights taken away, the court might allow the process to move forward without their consent.

3. File the Adoption Paperwork

  • The stepparent and their spouse must file legal documents with the court to start the adoption process.

4. Home Assessment and Background Review

  • A home visit may be necessary, with a report to the Court, to demonstrate that the environment is safe and supportive for the child.
  • The stepparent will also need to pass a background check.

5. Go to Court

  • A judge will review the case, and the stepparent and child may need to attend a hearing.
  • If the child is 14 or older, they may also need to provide their consent for the adoption.

6. Adoption Approval

  • Once the judge agrees that the adoption is in the child’s best interests, the adoption is finalized. If consent is not obtained, the court can evaluate whether the child has been abandoned by a parent. The Court then makes determinations whether it is in the Best Interests of the child for the adoption to proceed.

A new birth certificate may be issued, listing the stepparent as a legal parent.
