- A home visit may be necessary, with a report to the Court, to demonstrate that the environment is safe and supportive for the child.
- The stepparent will also need to pass a background check.
5. Go to Court
- A judge will review the case, and the stepparent and child may need to attend a hearing.
- If the child is 14 or older, they may also need to provide their consent for the adoption.
6. Adoption Approval
- Once the judge agrees that the adoption is in the child’s best interests, the adoption is finalized. If consent is not obtained, the court can evaluate whether the child has been abandoned by a parent. The Court then makes determinations whether it is in the Best Interests of the child for the adoption to proceed.
A new birth certificate may be issued, listing the stepparent as a legal parent.
