What Crimes Can Be Expunged in Missouri?

Missouri law allows many people to clear, or “expunge,” past criminal records, restoring civil rights in many situations, if they meet specific eligibility rules and waiting periods. Some crimes, however, can never be expunged.

Eligible Misdemeanors

Many non-violent misdemeanors can be expunged, including:

  • Minor drug offenses like possession of drug paraphernalia.
  • Property crimes, such as petty theft or shoplifting.
  • Some traffic violations, though not all, like first time DWIs.

Eligible Felonies

While it’s harder to expunge felonies, a number of non-violent felonies, not included on the excluded list, are eligible, such as:

  • Some Class D and E felonies, particularly related to drug possession or property crimes.
  • Some financial crimes, depending on the details of the case.

However, violent crimes, sexual offenses, and crimes involving children usually cannot be expunged. Repeated DWI and domestic assault convictions are also ineligible.
