How Missouri Law Classifies Motor Vehicle Theft

Under Missouri’s stealing statute, RSMo 570.030, stealing a motor vehicle is a class D felony. That classification applies automatically, no matter the vehicle’s value. A class D felony carries up to seven years in prison and a fine of up to $10,000.

Two factors can push that charge higher:

• Vehicle value of $25,000 or more: The charge becomes a class C felony, carrying three to ten years in prison.
• Two prior stealing-related convictions within the past 10 years: The charge rises to a class B felony, punishable by five to fifteen years in prison.

Motor Vehicle Stealing vs. Tampering vs. Vehicle Hijacking

Missouri law treats several offenses as distinct crimes that people often group together as “auto theft.” Each carries different elements and different penalties.

Tampering in the First Degree (Joyriding)

Tampering in the first degree means knowingly operating a vehicle without the owner’s consent. Unlike motor vehicle stealing, it doesn’t require intent to permanently deprive the owner of the vehicle. It is still a class D felony, with up to seven years in prison and a $10,000 fine.

Tampering in the Second Degree

This charge applies to a passenger who knowingly rides in a vehicle without the owner’s permission. It’s a class A misdemeanor, punishable by up to one year in jail and a $2,000 fine. A prior conviction for this offense or for stealing a motor vehicle raises it to a class D felony.

Vehicle Hijacking

When a vehicle is taken by force or the threat of force, the charge is vehicle hijacking. It’s a separate offense charged as a class A or class B felony, carrying significantly harsher penalties than standard motor vehicle stealing.
