Missouri Revised Statutes Chapter 565 defines two primary manslaughter offenses. Which charge applies determines both the sentencing exposure and the defense approach.

Voluntary Manslaughter
Voluntary manslaughter occurs when a person causes another’s death under the influence of sudden passion arising from adequate cause. That emotional state must be triggered by a legally recognized provocation sufficient to temporarily overwhelm judgment. This is a Class B felony, carrying 5 to 15 years in prison.

Involuntary Manslaughter
Involuntary manslaughter in the first degree involves recklessly causing another person’s death. No intent to kill is required. Under Missouri Revised Statutes Section 565.024, this is a Class C felony, punishable by 3 to 10 years in prison.

The critical distinction between manslaughter and murder is the absence of premeditation. Prosecutors sometimes charge factually ambiguous cases as murder under the felony murder rule, which applies when a death occurs during an inherently dangerous felony.
